On August 8, 2016, Cindy Martinez and her husband David Martinez filed a medical malpractice lawsuit against Dr. Minkailu Sesay, North East Georgia Physicians Group, Inc.; Northeast Georgia Physicians Group – Urgent Care, LLC and other related corporate entities. The complaint was filed in the State Court of Gwinnett County and is available upon request.

In the summer of 2015, Mrs. Martinez underwent amputation of both of her legs below her knees, her right arm above the elbow, large amounts of tissue and muscle on her left back and side, and portions of each of the fingers on her left hand. These amputations were medically necessary as a result of a skin infection from Group A Strep of unknown origin which progressed to sepsis, severe sepsis, septic shock and necrotizing fasciitis.

As alleged in the complaint, Mrs. Martinez sought medical care at the Northeast Georgia Urgent Care facility on Dacula Road in Gwinnett County on Sunday morning May 24, 2015. The complaint further alleges that her vital signs and symptoms clearly revealed that she was suffering from a serious systemic infection and sepsis.  The complaint goes on to allege that the doctor and nurse on duty at the urgent care facility failed to recognize and treat this obvious infection. The complaint continues by alleging that the resultant 24-hour delay in treatment of her systemic infection allowed it to progress further and ultimately made the amputations necessary in order to save her life. Allegedly, had proper care been provided at the Northeast Georgia Urgent Care facility, no amputations would have been necessary, and Mrs. Martinez would have continue to lead a normal life, raising her two young children with her husband David Martinez, a Gwinnett County Police Officer.  Both Mr. and Mrs. Martinez are Marine Corps Veterans.

The complaint further alleges that Mrs. Martinez’s past medical expenses have exceeded $1.6 million and her future medical and life care expenses will cost as much as $8 million. Additionally, she will incur lost wages of approximately $2 million over her remaining life.

Mrs. Martinez states, “I’ve never been involved in a lawsuit before, and I’m nervous about it, but I don’t want what happened to me to happen to anyone else.”
